These Terms and Conditions (“Terms”) govern your access to and use of the Myon Health Technology platform, applications, websites, and related services (“Myon Health Technology”, “we”, “our”, or “the Platform”). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
IMPORTANT — THE PLATFORM IS NOT FOR EMERGENCIES.
If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately, or go to your nearest hospital emergency department. Do not use the Platform to seek urgent or emergency medical care. Myon Health Technology does not monitor content entered into the Platform and cannot respond to emergencies.
If you are having thoughts of suicide, self-harm, or harming others, call or text 988 (the Suicide and Crisis Lifeline in Canada and the United States) to speak with a trained crisis counsellor, call 911, or go to your nearest emergency department. The Platform is not a substitute for emergency or crisis intervention and Myon Health Technology is not a mental health crisis service.
1. Overview of the Platform
Myon Health Technology is a patient-facing digital platform that enables users to store, access, manage, and share their personal medical records and related health information. The Platform may also provide AI-assisted features intended to help users interpret or organize their information. These features are informational only and are not a substitute for professional medical advice. Always review and confirm all information with a qualified healthcare professional. The Platform relies on third-party service providers (including cloud infrastructure providers, speech-to-text providers, and AI model providers such as Anthropic) to deliver certain features. A current list of material sub-processors, together with the categories of information they process and the jurisdictions in which they operate, is maintained in our Privacy Policy.
Myon Health Technology is not a custodian of any medical record and is not a healthcare provider. Transcripts, summaries, and other content generated through the Platform are your personal record of your interactions with healthcare providers. They are not clinical records, legal records, or official medical documentation, and they do not replace the clinical records maintained by your healthcare providers. You should not rely on content in the Platform as a complete or authoritative record of your care. Myon Health Technology complies with applicable law, including valid legal process, in responding to requests for content you have stored on the Platform.
2. Eligibility
You must be at least the age of majority in your jurisdiction to use the Platform on your own behalf. If you are using the Platform on behalf of another individual (e.g., as a parent, legal guardian, caregiver, or person acting under a valid power of attorney for personal care), you represent and warrant that you have the legal authority to do so and agree to these Terms on that individual's behalf. When a minor reaches the age of majority in their jurisdiction, caregiver or proxy access to the account will automatically terminate and control of the account and all associated health information will be offered to the individual, subject to identity verification. Further details on pediatric accounts, caregiver access, and account transitions are set out in our Privacy Policy.
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your login credentials
- Ensuring the information you provide is accurate and up to date
- All activity that occurs under your account
We may suspend or terminate your account if we suspect unauthorized use or violation of these Terms.
3.1 Notifications and Device Security
The Platform may send notifications to your email address, mobile device, or other contact method you have provided, including alerts when new information is available in your account. Anyone with access to your email account, device, or notification preview settings may be able to see these notifications, including partners, family members, or others who share access to your devices. You are responsible for securing the devices and accounts you use to access the Platform and for managing your notification preferences. You may turn off or adjust most notifications at any time through your account settings, except for Transactional Communications described in Section 23.
4. Consent for Data Collection, Use, and Sharing
By using the Platform, you consent to the collection, storage, processing, and sharing of your personal information as described in our Privacy Policy.
4.1 User-Initiated Sharing
You may choose to share your medical information with healthcare providers, caregivers, or other third parties. You are solely responsible for ensuring that such sharing complies with applicable laws and your personal preferences.
You may revoke a recipient's ongoing access to information you have shared through the Platform at any time by using the sharing controls in your account settings. However, once you have shared information with a third party, that third party may have downloaded, copied, or otherwise retained the shared information, and Myon Health Technology cannot retrieve, delete, or control any copy that exists outside the Platform.
Myon Health Technology is not responsible or liable for how any recipient uses, retains, shares, or further discloses information you have chosen to share with them. The decision to share, and the choice of recipient, is yours alone.
4.2 Recording, Transcription, and Communication Consent
Some features may involve audio, video, or text-based communication, including optional recording or transcription tools.
Canada (Single-Party Consent)
In Canada, including all provinces and territories, only one party to a conversation must consent to its recording. By using features that involve recording or transcription, you consent to such recording.
United States (All-Party Consent States)
In the United States, most states follow single-party consent. However, the following states require all parties to consent to recording:
- California
- Connecticut
- Florida
- Illinois
- Maryland
- Massachusetts
- Montana
- Nevada
- New Hampshire
- Pennsylvania
- Washington
If you use recording or transcription features while located in or communicating with someone in these states, you are responsible for obtaining all required consents.
You agree not to use the Platform to record or monitor communications in violation of any applicable law.
You may stop or pause recording and transcription at any time during a session. If you do so, or if the recording is interrupted for any reason (including technology failure or loss of device connectivity), only the portion of the session that was successfully recorded will be saved to your account, and any transcript or summary generated will reflect only the recorded portion. If you share a partial or interrupted transcript with any third party, you are responsible for making clear to the recipient that the transcript is partial and does not reflect the full session.
4.3 Consent Summary and Granular Choices
Because your information is sensitive, we ask you to make certain consent choices separately, rather than bundling them into your acceptance of these Terms. During onboarding, you will see a Consent Summary screen that explains, in plain language, the key ways in which we collect, use, and share your information, and that asks you to make specific opt-in choices under Section 21 (Use of Data for Research and Development). You can review and update these choices at any time through your account settings. Your choices under the Consent Summary screen form part of these Terms.
5. AI-Generated Content and Hallucination Disclaimer
The Platform may include AI-powered tools that generate summaries, interpretations, or suggestions based on your medical records or other inputs.
Important Notice
- AI-generated content may be inaccurate, incomplete, misleading, or inconsistent (“hallucinations”).
- AI outputs must not be relied upon for medical diagnosis, treatment decisions, or emergency situations.
- Always consult a qualified healthcare professional for medical advice.
Myon Health Technology uses artificial intelligence to generate summaries and transcriptions. While we strive for accuracy, AI systems may produce errors, omissions, or misinterpretations. This tool is not a substitute for professional medical advice, diagnosis, or treatment. All information provided should be considered supplementary only and must be reviewed and confirmed with your physician or qualified healthcare provider before acting on it. By using the Platform, you acknowledge that Myon Health Technology relies on third-party AI systems and that information will be processed externally to the Myon Health Technology platform. AI-generated content is provided “as is” for informational purposes only. To the fullest extent permitted by law, Myon Health Technology disclaims liability for any errors in the generated content, for the acts or omissions of any third-party AI provider, and for any decisions or outcomes resulting from your use of AI-generated content.
Where the Platform offers translation or multi-language features, translations are generated by machine translation tools and may contain errors, omissions, or inaccurate renderings of medical or technical terminology. Translated content is provided for convenience only and should not be relied upon for medical decisions. You should verify any translated information with a qualified bilingual clinician or interpreter before acting on it.
6. Not Medical Advice
Myon Health Technology does not provide medical, legal, or professional advice.
Nothing on the Platform should be interpreted as:
- A diagnosis
- A treatment plan
- A prescription
- A substitute for professional medical judgment
Always seek the advice of a licensed healthcare provider with any questions regarding your health.
7. User Responsibilities
You agree not to:
- Upload false, misleading, or unlawful information
- Attempt to access data belonging to other users
- Interfere with the Platform's security or functionality
- Use the Platform for any unlawful purpose
- Reverse-engineer, copy, or exploit the Platform's software or content
8. Intellectual Property
All content, software, trademarks, and materials on the Platform are owned by or licensed to Myon Health Technology. You receive a limited, non-exclusive, revocable license to use the Platform for personal, non-commercial purposes.
8.1 Your Content and Our Derivatives
The medical records, transcripts, AI-generated summaries, notes, and other content you upload to or generate through the Platform (“Your Content”) belong to you. Myon Health Technology receives only a limited, non-exclusive, revocable licence to access, process, store, display, and transmit Your Content as necessary to provide the Platform to you and to comply with applicable law. This licence ends when you delete Your Content or your account, subject to any legal retention obligations.
Subject to your opt-in choices under Section 21 and the prohibition on AI training in Section 22, Myon Health Technology may create, own, and use de-identified, aggregated statistical or analytical information derived from Your Content (“Derivatives”). Derivatives do not include Your Content itself, and Derivatives cannot reasonably be associated with you or used to re-identify you.
9. Third-Party Services
The Platform may integrate with third-party services (e.g., healthcare providers, cloud storage, identity verification). We are not responsible for the availability, accuracy, or practices of third-party services.
10. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your information. However, no system is completely secure. You acknowledge that you use the Platform at your own risk and that we cannot guarantee absolute security.
11. Limitation of Liability
To the fullest extent permitted by law:
- Myon Health Technology is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
- We are not liable for any loss, damage, or injury arising from:
- Use of or reliance on AI-generated content
- Errors or omissions in your medical records
- Unauthorized access to your account
- Service interruptions or data loss
- Interactions with third-party services
Our total liability for any claim arising out of or relating to the Platform will not exceed the amount you paid to use the Platform in the 12 months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater.
Nothing in these Terms excludes or limits Myon Health Technology's liability for: (i) fraud or fraudulent misrepresentation; (ii) willful misconduct; (iii) gross negligence; (iv) death or personal injury caused by Myon Health Technology's negligence; or (v) any other liability that cannot be excluded or limited under applicable law.
Some jurisdictions do not allow certain limitations; in such cases, the limitation applies to the maximum extent permitted.
12. Indemnification
You agree to indemnify and hold harmless Myon Health Technology and its officers, employees, contractors, and partners from any third-party claims, damages, liabilities, or expenses (including reasonable legal fees) arising from your: (i) breach of these Terms; (ii) misuse of the Platform; (iii) upload, submission, or sharing of content that is unlawful, inaccurate, or infringes the rights of any third party; or (iv) violation of any applicable law in connection with your use of the Platform.
13. Service Modifications
We may modify, suspend, or discontinue any part of the Platform at any time. We are not liable for any resulting loss or inconvenience.
14. Termination
We may suspend or terminate your access to the Platform if:
- You violate these Terms
- We suspect fraudulent or unlawful activity
- We discontinue the Platform
Upon termination, your right to use the Platform ceases immediately. Except where termination is the result of your material breach of these Terms or fraudulent or unlawful activity, Myon Health Technology will provide you with a reasonable opportunity (not less than thirty (30) days from the effective date of termination) to export your medical records and other content from the Platform in a commonly used, machine-readable format. Following the export period, Myon Health Technology will delete or de-identify your personal information in accordance with the retention and deletion practices described in our Privacy Policy, subject to any legal or regulatory retention obligations. You may also export your content at any time during your active use of the Platform through the export functionality provided in your account settings.
If a user of the Platform dies, Myon Health Technology will, on receipt of satisfactory proof of death and proof of authority of an estate representative, legacy contact, or similar designated person, address the user's account and content in accordance with the procedures set out in our Privacy Policy. Those procedures may include providing a read-only copy of the content, transferring control of the account to the designated person, or closing the account and deleting the content, as appropriate and as permitted by applicable law.
15. Inactive Accounts
If you do not sign in to or otherwise access your account for a continuous period of thirty-six (36) months, Myon Health Technology may designate your account as inactive. Before closing or deleting an inactive account, Myon Health Technology will make reasonable efforts to notify you using the contact methods associated with your account, and will provide you with a period (not less than sixty (60) days) during which you may reactivate the account by signing in, or export your content in accordance with Section 14. Following that period, Myon Health Technology may close the account and delete or de-identify your personal information in accordance with the retention and deletion practices described in our Privacy Policy, subject to any legal or regulatory retention obligations.
16. Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
You irrevocably agree that the courts of the Province of Saskatchewan have exclusive jurisdiction to settle any such dispute or claim, and you submit and attorn to the exclusive jurisdiction of those courts. Nothing in this section limits the right of Myon Health Technology to seek injunctive or equitable relief in any court of competent jurisdiction to protect its confidential information or intellectual property.
17. Dispute Resolution for Users Located in the United States
This section affects your rights. Please read it carefully.
If and when Myon Health Technology makes the Platform available to users located in the United States, additional dispute-resolution terms specific to United States users will apply to those users in place of Section 16. Those additional terms are expected to include binding individual arbitration, a waiver of class action and representative action claims, and a waiver of jury trial, each to the fullest extent permitted by the United States Federal Arbitration Act. Until Myon Health Technology makes the Platform available to United States users and publishes those additional terms, Section 16 governs all users regardless of location.
18. Changes to These Terms
We may update these Terms periodically. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

20. Accessibility
Myon Health Technology is committed to making the Platform accessible to users of all abilities and designs the Platform with reference to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter an accessibility barrier in using the Platform, or if you require your information from the Platform in an alternative accessible format, please contact us at info@myonhealth.ca and we will work with you to provide reasonable assistance. Accessibility feedback is welcome and used to improve the Platform.
21. Use of Data for Research and Development
21.1 Purpose
You acknowledge and agree that Myon Health Technology may use data collected through the Platform to support research, to improve health system operations, and to develop medical technologies and products (collectively, “Research and Development Activities”).
21.2 De identification and Data Cleaning
Prior to any sharing or use outside of Myon Health Technology's internal analytics, we will clean, aggregate, and de-identify data so that it does not include personal health information (PHI) or other information that could reasonably be used to re-identify you. De-identification will be performed in accordance with applicable law and industry standards.
21.3 Commercial Use
You understand and agree that de-identified or aggregated data may be shared with or sold to third parties and may be used for commercial purposes, including the development, licensing, or sale of medical technologies, products, or services. Myon Health Technology may derive revenue or other value from such uses. Myon Health Technology will not itself attempt to re-identify de-identified data, and will require, by written agreement, that any third party receiving de-identified data agree (i) not to attempt to re-identify any individual, and (ii) to use the data only for purposes consistent with this Section 21. You may withdraw your consent to commercial use at any time through your account settings or by contacting us; withdrawal will apply prospectively and will not require, or entitle you to, the return or destruction of de-identified data that has already been shared or used in reliance on your prior consent.
21.4 No PHI Associated
We will not share data that contains PHI or direct identifiers with third parties for Research and Development Activities unless we have obtained your explicit consent or are otherwise permitted by law. Any data shared for Research and Development Activities will be de-identified and will not be associated with your name, contact information, health card numbers, or other direct identifiers.
21.5 Consent — Granular Opt-In Choices
Because the uses described in this Section 21 involve sensitive health information, your consent is collected separately from your acceptance of these Terms. During onboarding (and at any time afterward through your account settings), you will be asked to make three separate, granular opt-in choices:
- Research. Whether de-identified data derived from your information may be used or shared for academic or public-interest research conducted by Myon Health Technology or by qualified research partners under written data use agreements.
- Health System Improvement. Whether de-identified data derived from your information may be used for internal analytics and shared with provincial or federal health system organizations to improve the delivery, quality, or efficiency of health services.
- Commercial Use. Whether de-identified data derived from your information may be shared with or sold to third parties for commercial purposes as described in Section 21.3.
Each choice defaults to opt-out (unchecked). Declining any or all of these choices will not affect your ability to use the core features of the Platform. You may change your choices at any time through your account settings; changes will apply prospectively. Where applicable law requires explicit, informed consent for a specific use of information that is not de-identified, we will obtain that consent separately before using or sharing that information.
21.6 Data Security and Governance
We will apply reasonable administrative, technical, and contractual safeguards when sharing de-identified data with third parties, and we will require partners to use such data only for the agreed Research and Development purposes.
21.7 No Warranty and Liability
You acknowledge that Research and Development Activities may not directly benefit you and that Myon Health Technology makes no promises regarding outcomes. To the fullest extent permitted by law, Myon Health Technology is not liable for third-party uses of de-identified data consistent with this section.
22. No Use of Your Data to Train AI Models
Myon Health Technology does not use your personal information, your medical records, transcripts, or AI-generated summaries (whether in identifiable or de-identified form) to train, fine-tune, or otherwise improve any artificial intelligence or machine learning model, whether our own or that of any third-party provider. We contractually require our third-party AI providers to process your information solely to provide the services we request, and not to use it to train their models. Nothing in Section 21 (Use of Data for Research and Development) authorizes the use of your data to train AI models; AI training is treated as a separate use that is outside the scope of the consents described in Section 21.
23. Electronic Communications
By creating an account, you consent to receive from Myon Health Technology electronic communications that are necessary to provide, secure, and administer the Platform, including account notices, password resets, security alerts, service updates, and legally required notifications (collectively, “Transactional Communications”). You cannot opt out of Transactional Communications while you maintain an active account. Myon Health Technology will only send you electronic commercial messages (such as newsletters, product announcements, or marketing communications, collectively “Commercial Communications”) if you have expressly consented to receive them. You may withdraw your consent to Commercial Communications at any time through the unsubscribe link in each message or through your account settings, without charge. This section is intended to comply with Canada's Anti-Spam Legislation (CASL) and any equivalent requirements in other applicable jurisdictions.
